Apple has failed to get Samsung to pay its lawyers’ fees for a patent infringement case in which it was awarded over $1 billion (£602m).
In a hearing in California, Lucy Koh, the judge who ruled Samsung should pay Apple the record damages in 2012, found in favour of the Korean company. It had argued that its breach of iPhone’s design was not exceptional and therefore it was not required to cover the cost of Apple’s attorneys.
During the trial in 2012, Samsung was found to have copied aspects of Apple’s design for the iPhone. However, it says that the utilitarian nature of the handset’s frame meant that it shouldn’t have to pay any extra fees.
Apple and Samsung’s long–lasting legal tussles are continuing in the United States. That’s despite the two revealing in a joint statement earlier this month that they were ending courtroom hostilities elsewhere around the globe.
As well as the $1 billion awarded in 2012, Apple won $120 million in damages in May this year after Samsung was found to have breached two patents belonging to the Cupertino firm. However, this was significantly less than it had been demanding, leading jurors in the case to suggest that it was time the battle was ended in an out–of–court settlement.
Further legal wrangling is expected in the States over the coming months, with Apple’s iPhone 6 set to be unveiled on the 9th September.
