Well word in the mobile phone industry is that they are waiting for one person and they will bring a lot of s*** to Apple's door. I mean Nokia have been making phones for longer than I can remember and they have got an absolutely huge patent portfolio, same goes for Sony Ericsson and Samsung. If Apple stupidly went after any of the big boys they would find themselves in a world of hurt, not only over iPhones, but iPods too as I'm sure Sony have got a massive amount of IP in the portable music world...
I hope Elan wins not because their case may/may not have any credibility but because it might dispel all the other manufacturers fear of incorporating multitouch in their new devices as they might get sued by Apple or leaped on by it's fanboys.
Although in a mildly decent world patent law wouldn't exist anyway, all it does is stifle innovation, increase prices and make a very small minority rich off an idea they probably had no role whatsoever in coming up with.
